All goods supplied by English Salvage (also referred to as ES) are sold subject to the following Terms and Conditions:

Condition, Age and Dimensions

Most of the goods we sell and supply are reclaimed or salvaged goods and subsequently exhibit wear and tear from previous use.  We make every effort to inform the customer about the general condition of the items we sell, but it is up to the customer to satisfy themselves that the condition, quality and function of the goods is suitable for the purpose and use required.  If you are not sure then you must advise ES of this at the time of purchase.

All ages quoted are approximate and are given to the best of our knowledge at the time of sale. All dimensions, areas, volumes or weights quoted are given as approximate. We will use imperial or metric systems at our discretion. 

Provenance

Wherever possible ES will provide information regarding the history of reclaimed items but can give no guarantee as to the accuracy of this information and no reliance should be placed on this information.

Prices

Any prices quoted may vary without prior notice. All prices quoted are Pounds Sterling.

Terms of Payment

Payment for goods must be made in full including VAT before collection or delivery.

The usual methods of payment accepted are selected debit and credit cards, direct bank transfer and cash.  Cheques may be accepted but goods will not be released until payment has cleared. English Salvage reserve the right to refuse certain types of payment.

Retention of Title

Goods supplied by us remain the property of English Salvage until payment has been received in full.

Warranties

Subject to the appropriate statutory limitations, no condition is made or to be implied, nor is any warranty given or to be implied, as to the quality, life, wear or suitability of any such goods supplied.

Reserving Goods

Items may be reserved without deposit for limited periods of time at our discretion. English Salvage retain the right to continue to advertise and sell the item on reserve.  We will normally endeavour to  notify a prospective customer if we mean to sell the item on reserve, to offer the customer the chance to buy the item, but we offer no guarantee of this. 

If a deposit is taken at the time of reservation, a time scale for complete payment will normally be agreed at the time of reservation with the purchaser, this will not usually exceed 2 weeks.  If full payment is not made within the time agreed the deposit will be considered forfeit.

Times

All timings, schedules and delivery dates quoted or estimated are approximate.

Custom made or Altered Goods

Where goods are made, altered or repaired for a customer, full payment for the goods will normally be requested before any work is undertaken.    Such items will not be accepted for return.

Storage

Once goods are paid for they may, at the discretion of English Salvage, be stored free of charge at our premises for an agreed period, not usually exceeding 2 weeks.  While we will make every endeavour to keep these items securely, the risk is with the purchaser.  After the agreed free storage time has elapsed English Salvage retain the right to charge storage fees, or if the goods remain on our property for more 6 months without prior agreement, to resell the item without refund to the customer.

Discounts

All discounts must be agreed in writing prior to delivery.  Discounts will be invalid in the event of late payment.

Use of Goods

The customer must satisfy himself that any goods ordered by him are suitable for the purpose for which they will be used. We hereby give notice that none of our employees are authorised to advise or recommend the suitability or otherwise of any product or products, and will not accept responsibility for any damage or loss directly or indirectly arising as a result of any incorrect or inadequate advice or recommendation. All goods are ‘sold as seen’.

Electrical and Gas Items

All goods sold containing gas or electrical components, or for use with such systems, are sold as scrap unless stated otherwise. The wiring will not be checked or warrantied by us. Any electrical lights or other devices must be thoroughly checked, rewired and fitted by a fully qualified electrician.

Delivery and Consequential Loss

Delivery will be charged extra and is subject to quotation.

While we will do our utmost to adhere to any time stated for delivery, we shall not be liable for any loss or damage howsoever caused by any delay in delivery, completion or performance of any contract, and any time stated for delivery shall not be a term of contract or a representation. In the event of ourselves being unable to supply or deliver the goods ordered, we undertake to refund any money paid in respect of such goods, but shall not otherwise be under any liability whatsoever. We shall not in any event be liable for consequential damage or loss.

Delivery shall be to the nearest kerbside unless otherwise agreed with the customer.  Delivery does not include unpacking, moving the goods once offloaded, product placement or any other manhandling of the goods, unless previously agreed in writing.  For larger items that cannot be offloaded with the delivery lorry's offloading facility, it is the buyer's responsibility and cost to provide adequate unloading facilities. Labour and/or plant required for unloading shall be supplied by the purchaser.  Provision of adequate Health & Safety measures shall be the sole responsibility of the customer or their appointed agent(s). No responsibility is accepted for any consequential loss or subsequent losses howsoever arising from the use of any materials or goods supplied.

Goods in Transit, Receipt and Inspection

Goods despatched by ES using a carrier, courier, post office or any other means must be inspected for damage on delivery and any damage or shortage should be marked as damaged on the Carriers delivery note and ES must be notified immediately by phone, confirmed by letter, email or fax. ES will not be responsible for damage reported after that period. 

Certain items such as glass or very breakable items cannot be insured for carriage and subsequently carriage is at the buyers risk and we cannot be held responsible for any breakages.  Having said that, we will of course do our utmost to ensure that items are packed carefully and securely to avoid any possible damage in transit.

Returns

The vast majority of the goods we sell are reclaimed, salvaged or antique. It is the customers sole responsibility to satisfy themselves that the condition, quality, and function of any goods are suitable for the purpose intended at the time of purchase.

You will then have 7 days during which time you may return the goods for a full refund, excluding return carriage costs. After that, any returns will be at ES's discretion. In the case of email or phone sales, where the customer has not physically examined the goods they must notify ES within 14 days of receiving their goods that they want to cancel. They have another 14 days to return the goods once they’ve notified English Salvage.

Items will only be considered for return if in the same condition, quality and quantity as first delivered.  Items will not be considered for return if they have been installed, used or altered in any way, shape or form.

The cost of returning goods will be at the client's account.

VAT

Prices include VAT levied at 20% when appropriate, unless otherwise indicated.

Some (but not all) of the reclaimed goods sold by ES are sold under the Margin Scheme for Second-hand Goods, whereby VAT is paid by ES on the difference between purchase and sale price, in these cases VAT cannot be reclaimed by the purchaser. Where this is the case this will be indicated on the invoice with a M symbol.

Any goods supplied to businesses in EC member countries will be invoiced without VAT as long as the buyer is registered for VAT in the country of destination and is able to supply a current VAT registered number. Otherwise VAT will be added at 20%.

Any goods supplied to non EU countries will be free of VAT subject to proof of export, by means of a Certificate of Shipment.

Currencies

Prices quoted are in Sterling. We may give an indication of the approximate equivalence in other currencies,  but we only accept payments in sterling and it is up to the purchaser to convert their currency to the correct sterling amount, any currency conversion charges will be borne by the purchaser.

Consequential Loss

ES accepts no responsibility for any consequential loss or subsequent costs howsoever arising from the use of new or reclaimed materials supplied by ES.

Law of Contract

Any contract entered into shall be governed by English Law and shall be subject to the exclusive jurisdiction of the English Courts.

Prohibited uses

  • Give the impression that they emanate from us, if this is not the case.
  • Advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.

Suspension and termination

We will determine, in our discretion, whether there has been a breach of this acceptable use policy through your use of our site.  When a breach of this policy has occurred, we may take such action as we deem appropriate. 

Failure to comply with this acceptable use policy constitutes a material breach of the terms of use upon which you are permitted to use our site, and may result in our taking all or any of the following actions:

  • Immediate, temporary or permanent withdrawal of your right to use our site.
  • Immediate, temporary or permanent removal of any posting or material uploaded by you to our site.
  • Issue of a warning to you.
  • Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.
  • Further legal action against you.
  • Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

We exclude liability for actions taken in response to breaches of this acceptable use policy.  The responses described in this policy are not limited, and we may take any other action we reasonably deem appropriate.
